定住者ビザのままでもいい？配偶者ビザに変更できるケースとは

再婚後も「定住者」のまま日本に滞在し続けることは可能です。ただし、新たな配偶者が日本人であれば、「日本人の配偶者等」ビザへの変更が選択肢となります。この変更には多くのメリットがあります。たとえば、在留期間の更新がしやすくなる、将来の永住申請が可能になるなどです。ただし、「再婚＝自動的に配偶者ビザが取れる」とは限りません。審査は厳しく、生活状況や婚姻の実態について詳しい説明が求められます。

再婚相手が外国人の場合、自分自身の在留資格は「定住者」のままとなることが一般的です。相手が日本に在留していない場合は、新たに「家族滞在」や「特定活動」などの在留資格を申請する必要があります。外国人同士の婚姻では、配偶者ビザへの変更はできません。さらに、再婚相手の在留状況によっては「扶養能力があるか」「本当に婚姻生活を送れるか」なども審査されます。

再婚によって、児童扶養手当が支給停止になることもあります。たとえ再婚相手が養子縁組していなくても、同居しているだけで「扶養義務者がいる」と判断されることがあるのです。しかも、手当の打ち切りは役所から事前に通知されるとは限らず、後日「過払い」として返還請求されることもあります。ビザの変更と並行して、福祉制度の見直しも必要です。
