For foreigners working in Japan, quitting a job is a significant event. If you sign documents without fully understanding them, or if your resignation is treated as voluntary, it may affect your visa or eligibility for unemployment benefits.
【トラブルになりやすいのは「退職の理由」】
会社から「辞めてほしい」と言われた場合でも、口頭だけでなく書類の内容をしっかり確認し、「会社都合」であることが明記されているかが重要です。「自己都合」として処理されると、失業保険の受給に3か月の待機期間が発生するなど、不利になります。
Even if your company asks you to leave, it’s important to confirm that the reason is clearly stated in writing as “company circumstances.” If it’s treated as a voluntary resignation, you may face a three-month waiting period before receiving unemployment benefits.
【サインは急がず、内容を確認してから】
退職届や同意書に署名を求められたときは、「なぜ退職するのか」「会社側の説明と一致しているか」を確認してください。特に「自分の意思で辞める」と書かれている場合、実際には会社都合だったとしても自己都合退職と見なされてしまいます。
Do not sign resignation documents in a rush. Always check whether the stated reason matches your understanding. If the document says you’re quitting by your own choice, it may be considered a voluntary resignation even if the company initiated it.
【会社の義務とあなたの権利】
労働基準法では、会社が社員を解雇する場合は30日前に通知するか、30日分の給与を支払う必要があります。また、ケガや病気で休んでいる期間や産前産後の30日間は解雇できないと定められています。これらを無視した退職勧告には応じる必要はありません。
Under Japan’s Labor Standards Act, if a company wants to terminate an employee, it must either provide 30 days’ notice or pay 30 days’ worth of wages. Also, termination is not allowed during medical leave or within 30 days after childbirth. You have the right to refuse unlawful dismissals.
【退職後のトラブルを避けるために】
「退職届にサインすれば終わり」ではありません。失業保険、健康保険、在留資格など、辞めた後に必要な手続きが多くあります。まずは退職理由がどう処理されているかを明確にし、疑問があるときはハローワークや行政書士に相談するのが安心です。
