最近、日本で「経営・管理ビザ」をとる外国人の中に、ほんとうに会社を経営しない人がいるという話が増えています。ビザを取ることだけが目的で、会社は名前だけ、というケースもあるそうです。でも、それはルールに反する行動です。
Recently, there has been an increase in cases where foreign nationals obtain the “Business Manager Visa” in Japan without actually running a company. Some people only want the visa, and their company exists only on paper. However, this goes against immigration rules.
このビザは「起業したい人」のためのもの
経営・管理ビザは、日本で会社を作って、きちんと経営したい外国人のための在留資格です。「500万円の資本金」「事務所をかりること」「しっかりした事業計画」が必要です。そして、実際に経営をしないと、在留の更新はできません。
The Business Manager Visa is for foreign nationals who seriously want to start a business in Japan. You need at least 5 million yen in capital, a rented office, and a solid business plan. If you don’t actually run your business, you won’t be able to renew your visa.
会社を作るだけでは足りません
最近は、「ペーパーカンパニー（書類だけの会社）」を作ってビザを取ろうとする人もいるようです。しかし、入管は会社の活動内容、売上、経営状況を見ています。書類だけでは通用しません。経営がされていないと判断されれば、更新はできず、ビザも取り消されることがあります。
Some people try to obtain the visa by creating a “paper company,” meaning a company that exists only on documents. But immigration authorities check the company’s activity, income, and operations. If they find there is no real business, your visa may not be renewed or could even be canceled.
民泊や名義貸しも問題になることがあります
とくに、民泊などのビジネスを使って、実態のない「会社」を作るケースがあります。また、「日本人の名前を借りるだけで、自分は何もしていない」という名義貸しも問題です。こうした行為は、入管法違反になる可能性があります。
Some people use businesses like short-term rentals (minpaku) to set up fake companies. Others use a Japanese person’s name while not doing anything themselves. These actions can violate immigration laws.
制度を守って正しく活用しましょう
日本は、海外からの優秀な経営者を歓迎しています。しかし、それは「本気で経営をする人」が対象です。「とりあえず日本に住みたいからビザがほしい」という目的では、制度の本来の意味から外れてしまいます。制度を守って、正しく使いましょう。
