外国人の配偶者が離婚したら在留資格はどうなる？

外国人が日本人と結婚して「日本人の配偶者等」の在留資格を持っている場合、離婚が成立すると原則としてその在留資格は維持できません。離婚後も引き続き日本に在留したい場合は、別の在留資格へ変更する必要があります。

If a foreign national holds the “Spouse or Child of Japanese National” visa and divorces their Japanese spouse, they generally cannot continue staying in Japan under the same visa. To remain in Japan, they must apply for a change to another status of residence.

母親が子どもを扶養している場合は「定住者」へ変更できる可能性あり

外国人の母親が日本人の子どもを引き取り、継続的に扶養・育児を行っている場合、「定住者」への在留資格変更が認められる可能性があります。特に、子どもが日本国籍を持っているか、日本の学校に通っている場合などは、人道的な観点から在留が許可されるケースが多く見られます。

If the mother has custody of the child and is raising them continuously, she may be eligible to change her visa to “Long-Term Resident.” This is especially true when the child is a Japanese national or attending school in Japan, as immigration authorities may consider humanitarian grounds.

子どもの在留資格はどうなるのか？

子どもが日本人であれば、当然ながら在留資格は不要です。一方、子どもが外国籍で「家族滞在」や「定住者」などの在留資格を持っている場合、母親の在留資格変更にあわせて、子どもも在留資格変更や更新を行う必要があります。親子が同一世帯で生活し、扶養関係が明確であることが重要です。

If the child has Japanese nationality, they do not need a visa. However, if the child is a foreign national under “Dependent” or “Long-Term Resident” status, their visa must also be updated in line with the mother’s status. Authorities will assess whether the mother and child live together and maintain a clear dependent relationship.

申請に必要な書類と注意点

「定住者」への変更申請には、離婚を証明する書類（離婚届受理証明書など）、子どもとの親子関係を示す書類（戸籍、住民票）、子の在学証明書や生活費の支弁能力を示す資料（収入証明書、雇用証明書など）が必要です。生活実態と扶養関係が継続していることが重視されます。

To change to “Long-Term Resident,” the applicant must submit documents such as a divorce certificate, proof of parent-child relationship (family registry, resident record), the child’s school certificate, and proof of financial stability (income and employment documents). Immigration authorities emphasize the continuity of living and support relationships.

不許可を避けるためのポイント

離婚後にビザを変更する際、必要書類の不備や生活基盤が不安定だと不許可になる可能性があります。また、別居していた期間が長い場合や、養育実績が確認できない場合も注意が必要です。子どもと同居している証拠や、日常的な育児の実態を具体的に示すことが重要です。

To avoid visa denial, it’s important to provide complete documentation and demonstrate a stable living situation. Long periods of separation from the child or lack of childcare history may raise concerns. Submit concrete evidence of cohabitation and everyday parenting efforts.
